Drink-driver loses appeal against conviction – 3FM

A man who notched up his sixth drink-drive offence last year has lost an appeal against his conviction.

James Marcus Doherty was arrested on September 14 last year after he was seen stumbling around the forecourt of a filling station in Ramsey and found to be more than twice the legal limit.

He pleaded guilty to driving with excess alcohol, but at appeal his advocate argued an adjournment should have been granted to allow expert evidence to be heard.

However, Judge of Appeal Storey and Deemster Montgomerie said Doherty’s conviction was safe and his 18-month prison sentence and seven-year driving ban should stand.
